By placing an order or using a website we build and host, you ("the customer", "you") agree to these Terms.

1. What we do

PrimeSpark IT builds a website for your business using automated tools and AI-generated content, then hosts it for you on an ongoing subscription. After your site is built we email you the website address and your login details.

2. Plans, fees and what's included

All prices are in Australian dollars (AUD). GST does not currently apply — PrimeSpark IT is not currently registered for GST, so no GST is charged on these prices. We will update this notice if we register for GST in future.

The setup fee is a one-time charge for building and publishing your website. The monthly fee is an ongoing subscription that covers hosting, SSL, and basic support (defined below). Both the setup fee and your first month are charged at the time of order; the monthly fee then recurs automatically each month until you cancel.

3. Basic support — what's included vs. what's extra

Content updates and additions are quoted and charged separately. Current add-on rates are available on request or on our website. We are not obliged to carry out any change that falls outside basic support without a separate agreed fee.

You can also make content changes yourself at any time using your WordPress admin login — basic support does not restrict your own access to edit your site.

Where you ask us to register a domain on your behalf, the cost may be included or charged separately as quoted. Some domains (for example .com.au) have eligibility rules — including holding a valid ABN — and may require a manual step. If you provide your own domain, you are responsible for keeping it registered and for authorising us to point it at your website.

7. Intellectual property

Once your setup fee is paid, you own the text and images that are specific to your business on your website. PrimeSpark IT retains rights to its underlying templates, tools, code, and systems. Third-party components (e.g. WordPress, themes, plugins) remain subject to their own licences.

8. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms limits rights you have under that law. Where permitted, our liability for a failure to meet a consumer guarantee is limited to re-supplying the service or paying the cost of re-supply.

9. Limitation of liability

To the extent permitted by law, PrimeSpark IT is not liable for indirect or consequential loss, loss of profits, or loss of data, arising from your use of the website or hosting. We do not guarantee specific business outcomes (such as search rankings, traffic, or sales).

10. Changes to these Terms

We may update these Terms from time to time. The current version is always available on our website, and material changes will be notified to you by email.

11. Governing law

These Terms are governed by the laws of Victoria, Australia.
